Terms of Service

These terms apply to the BirdyWatch Discord bot, which appears in servers as Birder, and to the website at www.birdywatch.com — together “the service”, operated by BirdyWatch (“we”). By playing, by adding the bot to a server, or by using this site, you agree to them. If you do not agree, do not use the service.

1. Who may use it

You need a Discord account, so Discord’s terms apply to you as well as these, and you must be at least 13. Adding the bot to a server requires the Manage Server permission; by adding it you confirm you are entitled to make that decision for the server. You can remove it at any time.

2. The service is in beta

BirdyWatch is being actively built. Features, scoring, spawn rates and the balance of every perk will change, sometimes without notice. Game data may be reset, rebalanced or wiped — scores, life lists, feather balances and checklists included. Treat progress during beta as provisional. We do not promise the service will be available, uninterrupted or error-free.

3. Playing fairly

You must not:

• automate play — scripts, macros or self-bots that type bird for you;
• use more than one account to gain an advantage;
• deliberately exploit a bug rather than reporting it through the suggestions form;
• attempt to disrupt, overload, reverse engineer or gain unauthorised access to the bot, this site or the database behind them;
• use the service to harass others, or to break the law or Discord’s rules.

We may suspend access or reset an account’s progress where someone breaches this section.

4. Feathers, perks and scores

Feathers, perks, Bird Call minutes, checklists and leaderboard positions are features of a game. They are not property and have no monetary value, cannot be sold or transferred, and may be adjusted — including to correct a balance that came from a bug or a breach of section 3.

5. Payments

Nothing is charged for at present, and everything in the shop is free while the game is being tested. The payment and checkout provider, and the refund policy, are still to be decided and will be published here before anything is charged. Card details will be handled by that provider, not by us.

6. Our material

The BirdyWatch name, the bot, this site, the game’s design and its written content are ours, as is the bird artwork — every image was made by us using AI image tools, so nothing is taken from another artist or a stock library. Please do not copy, redistribute, sell or reuse it outside the game. Sharing a screenshot of your own catch is fine.

Discord’s names, marks and software belong to Discord Inc. BirdyWatch is not affiliated with, endorsed by or sponsored by Discord.

7. Liability

Our services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy that the law says cannot be excluded. Where we are entitled to limit our liability, it is limited to supplying the service again or paying the cost of doing so.

Subject to that, the service is provided as it is and as available, and we are not liable for indirect or consequential loss, or for lost game progress.

8. Changes and governing law

We may update these terms as the game develops; the date at the top is the date of the current version, and continuing to use the service means you accept the update. These terms are governed by the laws of New South Wales, Australia.
